Christina Aguilera was released from police custody this morning after being arrested in the early hours for public intoxication. 

The 30-year-old mother of one hid her face as she was driven home from the West Hollywood police station at 7.30am. 

Her boyfriend Matthew Rutler, 25, left jail on $30,000 bail after being arrested for driving under the influence.

The singer had been taken in by police around 2.45am because she 'was not capable of taking care of herself' a Los Angeles Sheriff's spokesman has said.

Steve Whitmore, the chief public information officer for the Los Angeles Sheriffs department, spoke at a press conference in front of the West Hollywood station.

Aguilera was a passenger in the car driven by Rutler when officers said he was observed to be driving dangerously.

'They witnessed a person driving erratically,' Whitmore said.

'At 2.45am this morning a gentleman was stopped for allegedly driving under the influence. He was subsequently arrested and his passenger, Ms Aguilera, she was arrested.

'It was kind of a unique situation with this law as she was not capable of taking care of herself. She was incapacitated.

'She was cooperative and she was not belligerent in any way whatsoever. She was just intoxicated.'

Whitmore said the Sheriff's department had no intention of pressing charges on the singer but noted that she would have an arrest record.

He said: 'What we do in the situation is that we do indeed arrest the individual on misdemeanor public intoxication.

'But we have no desire to prosecute. None whatsoever, it is just for public welfare, public safety issues.'

Aguilera, who was listed at 5'2" and 100lbs on her booking sheet, was allowed to leave the station early this morning.

'When she was able to navigate and to think on her own and make her own way she was released at 7.30am this morning,' Whitmore said.

'As she got better, she said she would like to leave and that is what happened.

'Technically there was an arrest. However, there is no desire to prosecute.'

The arrest is the latest in a series of publicly humiliating moments for the singer.

She was forced to apologise after mixing up the words to the National Anthem during her Super Bowl performance on February 6.

She then tripped and fell to the ground while taking part in an all-star tribute to R&B legend Aretha Franklin at the Grammy Awards on February 13.

Aguilera began dating Rutler in November last year just two months after she split from her husband of five years, Jordan Bratman.

The former couple have a hree-year-old son, Max.

Aguilera and Rutler had met months earlier on the set of her movie Burlesque, which co-starred singing legend Cher.
