Carlos Tevez has escaped punishment from the FA for his part in the clash with Joey Barton on the final day of the season.

After the highly charged game between Manchester City and QPR, Joey Barton was handed a 12 match ban for his conduct towards Tevez, Sergio Aguero and City captain Vincent Kompany.

After Barton was sent off, City went on to record a title winning victory, beating QPR 3-2 with a last-minute Aguero strike.

The QPR midfielder clocked Tevez with an elbow, and received a straight red card from Mike Dean. He then booted Aguero in the back of the leg before throwing a headbutt in the direction of Kompany.

Beforehand Tevez appeared to strike Barton.

Dean had admitted, had he seen Tevez's actions, he would have sent him off too.

An FA disciplinary commission agreed that the Argentinian should have been dismissed, but will not take further action.

The commission's report, printed in The Times on Monday, read: 'Mr Dean was questioned (by the commission) about the 'Tevez incident' for which Barton was dismissed.

'It was confirmed that neither the referee nor the assistant saw the alleged incident of Mr Tevez striking Mr Barton, although Mr Barton immediately made representations to Mr Dean.

'That is what happened and such comments by Mr Barton can be clearly seen in the video.

'The commission accept that Mr Barton was aggrieved by the action of Mr Tevez and Mr Dean confirmed that had the incident been seen by the officials as shown by the clip supplied by Mr Barton, it would have been an automatic red card.

The commission find that this does not, however, excuse the subsequent action by Mr Barton in relations to Messers Kompany and Aguero.'

David Bernstein is totally honourable, no dishonesty here. He improved city and he is setting about improving the FA. Anyone implying impropriety is delusional, or red, or both

Tevez would/could have been red carded if the referee saw him, but none of the officials did - ang, wherever I lie my hat, 28/5/2012 22:47 ----------------- Lets try and explain the rules of the game to you in simple form, there is a thing called "Retrospective Action", i.e. when a ref and linesmen miss a decision which is picked up by either the fourth official and/or TV cameras, and 9 times out of 10 the offending player is hauled before the FA / Premier League and charges for his actions, Now seeing as you seem to have an opinion on everything maybe you can pass on your footballing wisdom as to why Mr Berstein decided not to charge the Mercenary.

Ther are dozens of corners and throw ins given to the wrong side all the time... the referee can only he act on what he sees. well, the fact is tevez is laughing and a title winner and barton is licking his wounds... that's what is important, winning, not losing it and barton lost it and will probably never see him again in the premiership.

Excuse me, with all respect to QPR obviously, but no one, included Barton should get into any argument or scuffle or row with Tevez... You take on Tevez on the pitch at your own risk, because 99% you are not going to win anything over Tevez. The guy knows all the tricks of the trade, mate... Tevez is not a player you can 'just take out.' Anyone with a bit of sense would keep well clear from starting anything with him, and Barton more that anybody else should have known... Well he know now anyway... What is amazing is that players like Barton and others, which have played enough games, should know these basic things and use common sense but they don't... Balotelli is another, start something with him and either you get your legs broken or you or him or both will end up red carded.
